1. About VividRange®
This site is operated by:
Openvista Ltd Trading as VividRange® Registered office: 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ contact@vividrange.io
References to “VividRange”, “we”, “us” or “our” mean the operator identified above.
2. Purpose of the site
The site presents information about VividRange® research areas, methodology, publications and bespoke services.
Public material may include:
- research questions;
- analytical commentary;
- methodology notes;
- simulations;
- illustrative examples;
- public summaries;
- Journal entries;
- information about potential engagements.
The site does not operate an online checkout or automatically accept commissions.
3. No contract created by browsing or enquiring
Viewing the site, sending an email or submitting an enquiry does not create:
- a research engagement;
- a client relationship;
- a duty to accept work;
- a confidentiality obligation;
- an advisory relationship;
- a commitment concerning price, timing or delivery.
A bespoke assignment begins only when the relevant parties accept written terms governing that commission.
Those terms may appear in a proposal, engagement letter, statement of work, contract or another agreed document.
Where a project agreement conflicts with these Website Terms, the project agreement takes precedence for that assignment.
4. Informational and analytical purpose
Public material is provided for general research, analytical and informational purposes.
It should not be treated as:
- a complete account of the underlying work;
- a guarantee that a result will recur;
- a substitute for professional advice;
- real-time assistance;
- prescriptive instruction;
- a recommendation tailored to a particular person or organisation.
The relevance of an analysis depends on its evidence, assumptions, scope and surrounding circumstances.
5. Financial Markets material
Nothing on the site constitutes financial, investment or trading advice, or a personal recommendation.
No publication should be understood as an invitation or instruction to buy, sell or hold a financial instrument.
Examples, datasets and simulations may be illustrative or hypothetical. They can depend on stated assumptions and do not predict future market outcomes.
6. Poker material
Poker combines decision-making with unavoidable chance and variance.
Analysis, datasets and simulations cannot determine the result of a hand, session or future sample.
Nothing published by VividRange guarantees performance or removes the financial risks associated with play.
7. No real-time assistance
The site does not provide live monitoring, immediate intervention or situation-specific instruction.
Material should not be used as a substitute for independent judgement during a market, game, operational event or other time-sensitive decision.
8. Ownership
Unless otherwise stated, the site and its original material belong to VividRange or the relevant identified rights holder.
Protected material may include:
- written research;
- Journal entries;
- graphics;
- diagrams;
- datasets;
- simulations;
- models;
- software;
- code;
- page design;
- brand elements;
- names and marks;
- proprietary methodology;
- mathematical engineering processes;
- implementation logic.
Some third-party material may remain the property of its original owner.
No transfer of ownership occurs merely because material is displayed publicly.
9. Limited permitted use
You may:
- view the site for personal or internal professional reference;
- print or save a reasonable extract for non-commercial use;
- link to a public page;
- quote a limited passage with clear attribution, where otherwise lawful.
Any permitted use must preserve the meaning, context and evidential status of the source.
A quotation must not suggest that VividRange endorses a person, organisation, product or conclusion.
10. Prohibited use
Unless specifically agreed in writing, you must not:
- reproduce a substantial part of the site;
- redistribute or republish its material;
- sell, sublicense or commercially exploit the work;
- present VividRange material as your own;
- remove copyright, attribution or status notices;
- extract content to create a competing publication, service, model or dataset;
- reverse engineer proprietary logic;
- reconstruct restricted methods from public summaries;
- train, refine or evaluate a commercial system using the material;
- scrape or collect content through automated means;
- interfere with security or normal operation;
- introduce malicious code;
- use the site unlawfully or deceptively.
Permission requests and commercial licensing enquiries should be sent to:
contact@vividrange.io
11. Trade marks
VividRange® and other identified names or marks may be used to distinguish the source of services, publications or research.
VividRange® is a registered trade mark of Openvista Ltd. Unauthorised use of the mark is prohibited.
You may not use a VividRange name, logo or mark in a way that creates confusion about ownership, sponsorship, endorsement or affiliation.
12. Enquiries and submitted material
Do not send information that you are not authorised to disclose.
Before submitting material relating to another individual, organisation or rights holder, ensure that you have an appropriate basis for doing so.
An unsolicited submission does not:
- require VividRange to review it;
- oblige either party to proceed;
- establish exclusivity;
- create an implied licence beyond what is needed to assess the enquiry;
- guarantee that the material can be treated as confidential.
Where sensitivity matters, confidentiality should be discussed before restricted information is supplied.
Personal information is handled according to the Privacy Notice.
13. Bespoke engagements
Research commissions are governed by their own written terms.
Those documents may address:
- scope;
- exclusions;
- evidence;
- assumptions;
- deliverables;
- review points;
- acceptance criteria;
- fees;
- invoicing;
- payment dates;
- changes;
- cancellation;
- confidentiality;
- intellectual property;
- permitted reliance;
- liability;
- governing law.
Commercial arrangements, including project duration and payment schedules, are agreed according to the circumstances of the assignment.
Nothing on this site imposes a standard timetable or default invoicing structure.
14. Accuracy and status
VividRange aims to describe public work accurately and distinguish established facts from hypotheses, assumptions, preliminary findings, interpretations, limitations and unresolved questions.
However:
- material may become outdated;
- an entry may reflect the evidence available at its publication date;
- errors or omissions may occur;
- a public summary may exclude restricted detail;
- later work may revise an earlier interpretation.
We may correct, update, withdraw or reclassify material without preserving every previous public version.
The absence of disclosed information does not imply a result, recommendation or degree of certainty.
15. Availability
We do not guarantee that the site or any particular page will always be available, uninterrupted or free from faults.
Access may be suspended, restricted or withdrawn for maintenance, security, legal, technical or operational reasons.
We are not obliged to keep a publication, feature or external link online indefinitely.
16. Security
Reasonable care should be taken when accessing any website or downloading a file.
Although proportionate measures may be used to protect the site, we do not guarantee that it will be free from viruses, malicious code or other harmful components.
You are responsible for using suitable security controls on your own systems.
You must not attempt to:
- gain unauthorised access;
- test vulnerabilities without permission;
- disrupt service;
- bypass access restrictions;
- misuse forms or communication channels.
17. External links
The site may link to information or services operated by third parties.
A link does not necessarily indicate endorsement, approval or continuing verification.
VividRange does not control external material and is not responsible for its availability, security, accuracy or privacy practices.
Review the relevant third party’s terms and notices before relying on its service or supplying information.
18. Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful.
This includes liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- any other matter that cannot legally be excluded or restricted.
Subject to those protections, VividRange is not responsible for loss arising solely from:
- reliance on public material outside its stated purpose;
- use of an analysis in circumstances for which it was not prepared;
- decisions based on incomplete summaries;
- market movements;
- gambling outcomes;
- third-party websites;
- interruptions outside reasonable control;
- unauthorised reproduction or alteration of the work.
Where you use the site for business purposes, VividRange will not be liable under these Website Terms for indirect or consequential loss, loss of profit, loss of revenue, loss of opportunity, loss of anticipated savings, loss of data or damage to reputation, to the extent such liability may lawfully be limited.
These Website Terms do not determine liability for a bespoke engagement. Any applicable allocation or cap will be stated in the written terms for that commission.
Nothing here affects statutory rights available to a private client where those rights cannot lawfully be limited.
19. Suspension or restriction
We may suspend or restrict access where we reasonably believe that a visitor has:
- breached these terms;
- infringed intellectual-property rights;
- threatened security;
- interfered with another person’s use;
- acted unlawfully;
- misrepresented VividRange material.
This does not limit any other right or remedy that may be available.
20. Privacy and cookies
Use of personal information is explained in the Privacy Notice.
Storage and access technologies are addressed in the Cookie Policy.
Where consent is required for an optional technology, it should remain inactive until the necessary choice has been obtained.
21. Changes to these terms
These terms may be revised when the site, services, operating arrangements or legal requirements change.
The date at the top of the page identifies the current version.
Changes apply from publication unless another date is stated. They do not retrospectively replace written terms already agreed for a bespoke commission.
22. Severability
If a provision is found to be unlawful or unenforceable, the remaining terms will continue to apply.
Where practical, the affected provision should be treated as modified only to the extent required to make it valid.
23. No waiver
A delay or failure to enforce a provision does not waive the right to enforce it later.
24. Governing law and jurisdiction
These Website Terms are governed by the law of England and Wales.
The courts of England and Wales will have jurisdiction, subject to any mandatory rights available to a private client in another part of the United Kingdom or another jurisdiction.
25. Contact
